InstaBot

Terms of Service

Last updated: 3 October 2026 · Effective for all accounts from this date

These Terms of Service (the “Terms”) are a binding agreement between you and SmartyAI Ltd, a company registered in England and Wales under company number 15254574, whose registered office is at 20 Wenlock Road, London, N1 7GU, United Kingdom (“SmartyAI”, “we”, “us”). They govern your use of InstaBot, including www.instabot.gr, app.instabot.gr, the InstaBot app, its AI assistant (the “Copilot”), Autopilot, SEO Blog and every related feature (together, the “Service”).

By creating an account, signing in, buying a plan or credits, or using the Service in any way, you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Service.

1. Business use only

1.1 The Service is provided only to businesses and professionals acting for purposes relating to their trade, business, craft or profession. It is not offered to consumers. By using the Service you confirm that you are using it for business purposes.

1.2 You must be at least 18 years old. If you accept these Terms for a company or other organisation, you confirm that you are authorised to bind it, and “you” means that organisation.

1.3 Because the Service is for business use, statutory consumer rights (including any right to withdraw from a distance contract within 14 days) do not apply. If, despite clause 1.1, mandatory consumer law applies to you, nothing in these Terms removes rights that cannot be excluded by law.

2. The Service

2.1 InstaBot uses artificial intelligence to plan, write, design and publish social-media content (posts, carousels, reels, animations and AI video), articles for your website, and related material, and to report on results.

2.2 We may change, improve, add or remove features at any time. Features described as beta, preview or experimental are provided as they are and may change or end without notice. We will give reasonable notice before removing a core paid feature you rely on.

2.3 Some features depend on third-party services (for example Meta/Instagram, our social-media planner provider, WordPress, Stripe and AI model providers). Their availability and rules are outside our control (see section 11).

3. Your account

3.1 You must give accurate information and keep it up to date. You are responsible for everything that happens under your account and for keeping your sign-in details secure. Tell us at once at support@instabot.gr if you suspect unauthorised use.

3.2 Agency accounts. If you manage brands for others, you confirm that you have each brand owner’s permission to create content for them, connect their accounts and share their data with us. You are our only customer for those brands: you are responsible for your clients’ instructions, approvals, content and payments, and for any claim they make.

4. Plans, credits and payment

4.1 Plans, prices and what each plan includes are shown on our pricing page and in the app at the time you buy. Prices exclude VAT and other taxes, which are added where applicable.

4.2 Paid plans are billed in advance, monthly, and renew automatically until cancelled. Payments are processed by Stripe; we do not store your card details.

4.3 Credits. Actions in the Service use credits; the number of credits is shown before you confirm an action.

4.4 If an action fails because of our systems, its credits are returned automatically to your balance. This is your sole remedy for a failed action.

4.5 Free plan and trials. Free plans and trials are offered at our discretion, with the limits shown in the app, and we may change or end them. One free plan per business; creating several accounts to obtain more free use is not allowed.

4.6 Price changes. We will give at least 30 days’ notice of a change to your plan’s price. The new price applies from your next billing period after the notice; you may cancel before then.

4.7 Late or failed payment. If a payment fails, we may limit or suspend paid features (including Autopilot and publishing) until it is paid. Amounts paid are non-refundable, including for partly used periods, unless the law requires otherwise or we agree in writing.

4.8 If you dispute a payment with your bank instead of contacting us first, we may suspend your account while the dispute is open.

5. Cancellation, suspension and termination

5.1 You can cancel at any time in the app or by email. Your plan stays active until the end of the period you have paid for and then ends; there is no partial refund.

5.2 We may suspend or close your account, immediately and without liability, if you breach these Terms, do not pay, use the Service unlawfully or abusively, put other users, us or our providers at risk, or if a provider or authority requires it. Where reasonable we will tell you first and give you a chance to fix the problem.

5.3 After your account closes, publishing and scheduled actions stop. You can download your posts until then. We delete account data as described in our Privacy Policy.

6. AI-generated content

6.1 Content is produced by artificial intelligence. It can be wrong, incomplete, out of date, similar to content made for others, or unsuitable. Images and videos can contain errors, invented details or imperfect text. Results vary and the same request can give different results.

6.2 You are the publisher. You are solely responsible for reviewing all content and for everything published to your accounts or website, including whether it is accurate, lawful, suitable, and compliant with advertising rules, platform rules and the rights of others.

6.3 Autopilot and automatic publishing. If you switch on automatic publishing (for social media or for your blog), you instruct us to publish without your review at the scheduled time, and you accept full responsibility for that content as if you had published it yourself. You can switch automatic publishing off, skip, edit or delete posts at any time before they are published.

6.4 Do not rely on content for medical, legal, financial, tax, safety or other professional matters, and do not publish prices, offers, dates or claims without checking them. Content only uses the facts you give us where the app says so; you remain responsible for checking them.

6.5 Where the law or a platform requires AI-generated content to be labelled, you are responsible for labelling it. We may add labels or metadata where required.

6.6 We do not guarantee any result, including reach, followers, engagement, bookings, sales, search rankings or revenue.

7. Your content and our licence

7.1 You keep all rights in what you give us: logos, photos, videos, texts, brand details, website and Instagram content, and instructions (“Your Content”).

7.2 You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, process, adapt, display and transmit Your Content, and to send it to our service providers (including AI model providers), only as needed to provide, secure and support the Service. This licence ends when Your Content is deleted, except for copies kept as described in our Privacy Policy.

7.3 You confirm that you own or have permission to use Your Content and the websites and accounts you ask us to read, and that our use of them as described here will not infringe anyone’s rights or break any law.

7.4 Output. As between you and us, you own the posts, articles and other material the Service creates for your account (“Output”), and we assign to you any rights we may have in it. We cannot guarantee that Output is protected by copyright, is unique, or is free of third-party rights. Stock media we include (for example from Pixabay) remains subject to its provider’s licence.

7.5 We may use anonymous, aggregated information about how the Service is used (never your identifiable content) to run and improve the Service.

8. Acceptable use

You must not use the Service to create, publish or store anything, or act in any way, that:

We may remove content, refuse an action, or suspend accounts that we reasonably believe break this section.

9. Connected accounts and publishing

9.1 To publish, you connect your Instagram/Facebook account through our social-media planner provider using the platform’s official sign-in. We never see your social-media password. You can disconnect at any time.

9.2 Publishing depends on the platforms. A post may be delayed, changed or rejected by a platform, and platforms may limit reach, restrict features or suspend accounts. We are not responsible for platform decisions, outages, API changes or their effect on your account or results.

10. SEO Blog

10.1 If you connect a WordPress website, you give us an application password for a user you create for InstaBot, and you authorise us to create drafts, schedule or publish articles and upload images according to the mode you choose. Use a dedicated user with the lowest role that allows this (Author) and revoke the password at any time in WordPress.

10.2 You are responsible for your website, its backups, its security and everything published on it. We do not guarantee indexing, rankings or traffic, and we are not responsible for changes made by WordPress, plugins, themes or hosting.

11. Third-party services

The Service works with services we do not control, including Meta (Instagram, Facebook), our social-media planner provider, WordPress, Stripe, Google, Clerk and AI model providers. Your use of them is also subject to their own terms. We are not liable for their acts, omissions, availability, pricing or changes.

12. Availability and support

We aim to keep the Service available and to fix problems quickly, but the Service is provided “as is” and “as available”. It may be interrupted for maintenance, updates, provider outages or reasons beyond our control. No service-level commitment applies unless agreed in a signed document. Support is provided by email at support@instabot.gr, in Greek and English.

13. No other warranties

To the fullest extent permitted by law, we exclude all warranties, conditions and terms not expressly stated in these Terms, including any implied terms of satisfactory quality, fitness for a particular purpose, accuracy, non-infringement or uninterrupted operation.

14. Limitation of liability

14.1 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.

14.2 Subject to 14.1, we are not liable, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any:

14.3 Subject to 14.1, our total liability arising out of or in connection with the Service and these Terms in any 12-month period is limited to the amount you paid us in the 3 months before the event giving rise to the claim, or £100 if you have not paid us anything.

14.4 Any claim must be brought within one year after you became aware, or ought reasonably to have become aware, of the facts giving rise to it.

15. Your indemnity

You will indemnify and hold harmless SmartyAI, its directors, employees and providers against all claims, losses, damages, fines, costs and expenses (including reasonable legal fees) arising from: Your Content; content published to your accounts or website; your breach of these Terms or of any law; your use of connected platforms; and, for agency accounts, any claim by your clients or the brands you manage.

16. Data protection

16.1 Our Privacy Policy explains how we process personal data as a controller (for example your account and billing details).

16.2 Where Your Content contains personal data of other people (for example customers or staff shown in photos or mentioned in posts), you are the controller and we process it as your processor. In that case: we process it only to provide the Service and on your documented instructions (these Terms and your use of the app); we ensure our staff are bound by confidentiality; we apply appropriate security; we use the sub-processors listed in our Privacy Policy, which you authorise, and will notify changes by updating that list; we will help you respond to data-subject requests and meet your security and breach obligations where required; we will notify you without undue delay of a personal-data breach affecting your data; we will delete it when your account closes as described in the Privacy Policy; and we will make available information reasonably needed to demonstrate compliance. You confirm you have a lawful basis, and have given any notices required, for sharing that personal data with us.

17. Confidentiality

Each party will keep confidential the other’s non-public information received through the Service and use it only for this agreement, except where disclosure is required by law.

18. Events beyond our control

We are not liable for any delay or failure caused by events beyond our reasonable control, including outages of hosting, AI or platform providers, internet failures, cyber-attacks, labour disputes, natural events, epidemics, war or government action.

19. Changes to these Terms

We may update these Terms. We will give at least 30 days’ notice by email or in the app of material changes; other changes take effect when published here. If you continue to use the Service after a change takes effect, you accept the new Terms. If you do not agree, cancel before it takes effect.

20. General

21. Governing law and disputes

These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or the Service are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction. Before going to court, both parties will first try in good faith to resolve the dispute by contacting each other in writing for at least 30 days.
